The Global Flood Awareness System (GloFAS) – terms and conditions of access

By registering and accessing the Global Flood Awareness System (GloFAS) forecast viewer or the GloFAS web services (hereinafter the "GloFAS products"), you agree to be bound to all terms and conditions provided herein including, in particular, the limitations on use, transferability, warranty and liability. If you are agreeing to these terms on behalf of a company or other legal entity, you represent that you have the legal authority to bind that company or legal entity to these terms. The terms provided herein are complemented by the terms of the Commission Legal Notice and Privacy Statement, unless otherwise expressly stipulated herein.

General Remarks: GloFAS is a global flood forecasting system which is jointly developed between the Joint Research Center (JRC) of the European Commission and the European Centre for Medium-Range Weather Forecasts (ECMWF). GloFAS is still in research phase and is producing daily forecasts only in a pre-operational mode.

GloFAS Products: Access to the GloFAS products is provided free of charge subject to registration. As a registered user (the “GloFAS user”) you are granted access the GloFAS products. In doing so, you understand and agree to the following:

  1. GloFAS products are provided for information purposes only. This means they do not constitute in any way a flood warning for which only national/regional institutions are authorized within their region of responsibility.
  2. GloFAS products are research products. This means products will not be free from errors or omissions. In addition, changes to the products might occur frequently and without prior notice.
  3. Certain GloFAS products are provided under license from third parties, including but not limited to ECMWF weather forecasts, and are subject to copyright and other intellectual property rights owned by ECMWF and/or other third parties. Third-party rights may be subject to specific conditions imposed by respective right-holders. These conditions, which you agree to respect, may be displayed in the metadata of the concerning product.

Use of GloFAS products: Without prejudice to third-party specific conditions, access and reproduction of GloFAS products is authorised, provided the source is acknowledged and referenced 1. Unless you have received prior written authorisation from JRC and ECMWF you shall not modify GloFAS products. The rights provided herein to you are non-transferrable.

The name, the copyright and the intellectual and industrial property rights related to the GloFAS products, including database rights where enforceable, are not sold to you and shall remain the exclusive property of the respective right-holders.

Appropriate conduct: While using the GloFAS products you agree that you are solely responsible for complying with these terms and conditions and with any other obligation that may be applicable under law.

Disclaimer of warranties and limitations on liability: The GloFAS user acknowledges that the information contained in the GloFAS products is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, any implied warranty against infringement of third parties' property rights, of merchantability, integration, satisfactory quality and fitness for a particular purpose. In particular nothing in these terms and conditions should be interpreted as a guarantee that the information contained will be free from errors or omissions, and that such errors or omissions can be rectified. For the sake of clarity, neither JRC nor ECMWF shall be held liable for any decisions taken by the GloFAS users or any other parties based on information from GloFAS products.
